Landlord Electrical Obligations — The Legal Position

Under the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020, landlords must:

►Have the fixed electrical installation inspected and tested at least every five years by a qualified person

►Give a copy of the report to existing tenants within 28 days of the inspection

►Give new tenants a copy before they occupy the property

►Supply a copy to the local authority within seven days if they request one

►Carry out any C1, C2 or further investigation work within 28 days — or sooner if the report says so

►Obtain written confirmation that the remedial work is complete, and pass that to the tenant and the local authority within 28 days

Local authorities can impose financial penalties of up to £30,000 per breach and, where a property is unsafe, arrange remedial work themselves and recover the cost from the landlord. The government guidance for landlords sets out the duties in plain English.

At least every five years, or sooner if the report itself specifies a shorter interval. A new tenancy does not reset the clock — but you must give every new tenant a copy of the current report before they move in.

Not always. An older board is not automatically a failure, but a rewireable fuse box with no RCD protection usually attracts C2 codes and will make the report unsatisfactory. We’ll tell you straight whether yours needs changing or not.

There’s no law that names PAT testing specifically, but landlords must keep supplied appliances safe, and employers have duties under the Electricity at Work Regulations 1989. For HMOs, licensing conditions in Bournemouth and Poole commonly require appliance testing, and most insurers expect a current register.
